This page outlines the Terms and Conditions applicable to a registered user or any individual who browses/ accesses any information/ uses platform or services of Quantsapp Wealth Private Limited (private limited company incorporated under the Companies Act, 2013, CIN No.: U67110MH2021PTC360161) which is an AMFI Registered mutual fund distributor with ARN 257080.
Please read the Terms & Conditions thoroughly before your register on our Platform (Webapp or Mobile App) or browse/access any content or information; or invest through the platform.
When you register on our platform, create an account, provide us with your personal information, use our platform and services or even access or browse our platform, you are acknowledging and agreeing to follow these Terms and Conditions and Our Privacy Policy available on our platform. You further agree to accept the updated Terms and Conditions as may be updated time to time on the mobile/web application of Quantsapp Wealth Pvt. Ltd. before executing the transactions.
If you do not wish to accept these Terms and Conditions or the Privacy Policy, you should not use or platform and services or/ and create an account/register with us.
Terms and Conditions
Definition:
In these terms and conditions, the terms shall have following meaning unless stated otherwise:
1. “BSE” shall mean BSE Limited
2. “Investor/ Client” shall mean client of the Participant who have requested for registration for Mutual FundTrading facilities.
3. “Platform” shall mean Quantsapp Wealth Pvt. Ltd. (via any of the following platforms, "Webapp", "Android Mobile")
4. “Mutual Fund Transaction Facilities” shall mean BSE StAR MF
1. USER REGISTRATION
I hereby provide my agreement and consent to open an investment account facility with Quantsapp Wealth Pvt Ltd, an AMFI registered distributor, for the purpose of conducting online mutual fund transactions through the website or mobile application, collectively referred to as Quantsapp Wealth Pvt. Ltd.
I grant my consent to be contacted using the contact number and email address provided by me, for the purpose of receiving information about Quantsapp Wealth Pvt. Ltd. products and services.
2. INFORMATION FOR "Know Your Client" (KYC)
I hereby allow Quantsapp Wealth Pvt. Ltd. to utilize my information such as PAN, photo, name, father's name, Date of Birth, gender, marital status, proof of address, address and signature etc. for sending it to KYC Registration Agency (KRA) as part of Know Your Customer (KYC) norm & BSE StAR MF as part of my application to BSE. This can be used for the purpose of validation and to comply with the legal and regulatory requirements.
I understand and agree that the BSE StAR MF shall be entitled to carry out further checks to validate the authenticity of the request and/or to reject/disallow any transaction in connection herewith.
I confirm that details provided by me, in "Know Your Client" (KYC) process are true and correct.
3. BANK DETAILS
I hereby declare that the details of the bank provided on the platform by me, belongs to me and the primary account holder of the account is me and any refunds should be credited to the aforementioned account which is provided by me.
I hereby declare that I am the primary account holder of the Netbanking account and/or e- mandate/ UPI used to make the transaction.
I hereby authorize Quantsapp Wealth Pvt. Ltd. and/or its authorized service provider(s) to
a. execute the NACH/Direct Debit mandate, as well as any subsequent NACH/Direct debit instructions pertaining to my investments and electronic money transfer instructions through online payment gateway(s)
b. process all mutual fund subscription, redemption, and non-financial instructions that I provide via the web/mobile application using the mobile number and Password (log-in credentials) associated with my Investment Account. This includes instructions provided through the mobile application or any other mode, including physical forms.
c. communicate with BSE StAR MF/AMC for both financial and non-financial transactions, and to receive information regarding my investments from BSE StAR MF/AMC, on my behalf.
4. TERMS OF TRANSACTIONS FOR MUTUAL FUNDS
I acknowledge that investment products do not pertain to Quantsapp Wealth Pvt. Ltd. and the company is not in the business of providing investment advice.
I acknowledge that Quantsapp Wealth Pvt. Ltd. will forward my transaction to BSE StAR MF after validation/completion of the "Know Your Client" (KYC) process, if my KYC is incomplete.
I confirm that the commissions (trail commission or any other mode) have been disclosed to me, by mutual fund distributor, Quantsapp Wealth Pvt Ltd, payable to them for the different Schemes of various Mutual Funds/AMCs, through the disclosures on the web/mobile application.
I acknowledge that Quantsapp Wealth Pvt. Ltd. will make every effort to process my instructions. I understand that if my instructions are received before the cut-off time(s) specified by Quantsapp Wealth Pvt. Ltd., they will be processed on the same business day. If received after the specified cut- off time(s), my instructions will be processed on the next business day. Quantsapp Wealth Pvt. Ltd. may specify cut-off time(s) that are earlier than those specified by the AMC/SEBI. I will not dispute and/or hold Quantsapp Wealth Pvt. Ltd. responsible for any loss, notional or otherwise, incurred because of
a. delays either at the Bank, Registrar and Transfer Agency or AMC.
b. rejection of my instructions by the Bank, Registrar and Transfer Agency or AMC.
c. processing of instructions authenticated by my Login Credentials.
d. non-availability or non-accessibility of the Website, telephone(s), or office(s) of Quantsapp Wealth Pvt. Ltd. in case of circumstances beyond Quantsapp Wealth Pvt. Ltd. control.
I understand that Quantsapp Wealth Pvt. Ltd. will process my instructions on a best effort basis. FORCE MAJEURE
If the whole or any part of the performance is prevented, hindered or delayed by a Force Majeure event (as defined below), Company shall not be liable for any failure to perform any of its obligations under these terms and conditions or those applicable specifically to its services/facilities, and in such case its obligations shall be suspended for so long as the Force Majeure event continues.
“Force Majeure Event” means any event, due to any cause beyond the reasonable control of Company, including without limitations, unavailability of any communication systems, breach, or virus in the digital processes or payment or delivery mechanism, sabotage, fires, floods, explosions, acts of God, civil commotion, strikes, riots, insurrection, war, government actions, lockdowns, computer hacking, unauthorized access to computer data and storage devices, computer crashes, malfunctions in computer terminals, damage caused by malicious or corrupting code or programs, mechanical or technical errors or failures, power shutdowns, and faults or failures in telecommunications, etc.
I acknowledge my responsibility to maintain the confidentiality of my Quantsapp Wealth Platform account, including login credentials and OTPs. In the event that my device is lost or stolen, I understand that it is my responsibility to promptly take necessary actions to secure my Quantsapp Wealth Platform account, such as blocking my SIM card and logging out of any active sessions. I agree that I will also promptly inform the Company by providing in writing at [email protected] and furnishing all relevant information.
I understand and agree not to hold Quantsapp Wealth Pvt. Ltd. responsible for any transactions rejected by the Exchanges/ AMC/ RTA due to any reasons.
I acknowledge if I have placed a redemption (full or partial) request from a channel other than ARN holder (Quantsapp Wealth Pvt Ltd) then the available withdrawal amount on Quantsapp Wealth Pvt. Ltd. web/mobile application may not be in sync. I acknowledge that under such circumstances redemption order may fail or be partially fulfilled.
I understand that after my withdrawal request is processed by Quantsapp Wealth Pvt. Ltd. the money may take upto 1 business day (for debt funds) and 3 business days (for equity funds) to be credited to my bank account.
I understand that there may be early exit charges as per SID / SAI / KIM of the scheme(s), of Mutual Funds, chosen through the mobile/web application.
5. ADDITIONAL TERMS AND CONDITIONS
I understand and agree that Quantsapp Wealth Pvt. Ltd. shall make available the Mutual Fund Transaction Facilities for the schemes of Mutual Funds which have entered into an agreement with Quantsapp Wealth Pvt. Ltd. (“eligible schemes”).
I agree that, any loss/ damages caused due to wrong information being submitted by me shall be my sole responsibility and I shall keep Quantsapp Wealth Pvt. Ltd. indemnified for the same.
I agree and understand that Quantsapp Wealth Pvt. Ltd. is only a facilitator for the client for applying in the Mutual Fund units. Allotment of units shall be at the sole discretion of the respective Asset Management Company (“AMC”) and the facilitator, shall not be held liable or responsible for any act/ deed/ non-action of the AMC.
I agree not to hold Quantsapp Wealth Pvt. Ltd. responsible for any transactions rejected by the Exchanges/ AMC due to any reasons.
The client agrees and understands that in case physical documents are being submitted for any transaction, the Client shall be solely responsible for the timely submission of the same. Participant shall not be responsible for any lost profits or charges levied by Exchanges/AMC, etc due to non- submission of documents within the prescribed time limits.
I agree that before giving any instruction for sale/ redemption order of Mutual fund units, I shall ensure and check the availability of units, prior to execution of sale/ redemption order and in case of non-availability of the same, shall not be hold Quantsapp Wealth Pvt. Ltd. responsible for non- execution of any such sale/redemption order.
I agree to receive all communication, etc in electronic form at the mobile number/email id provided by me, to Quantsapp Wealth Pvt. Ltd.
I agree to indemnify, defend, and hold Quantsapp Wealth Pvt. Ltd. and their respective representatives, directors, associates, and employees, harmless from and against any and all losses including reasonable legal fees and expenses, of third parties relating to or arising out of: (i) breach of any of the provisions of this Terms of Use and/or Privacy Policy; or (ii) fraud or dishonesty relating to any transaction by me; or (iii) misrepresentation/fraud/negligence with respect to data and information provided by me.
I and Quantsapp Wealth Pvt. Ltd., agree to refer any claims and/ or disputes to the Arbitration under the Indian Arbitration and Conciliation Act, 1996. The Service as outlined above shall be governed by the laws of India and will be subject to the exclusive jurisdiction of the courts in Mumbai. The laws of India govern this Agreement. All disputes are subject, firstly, to mediation, and then by Arbitration by a sole arbitrator appointed by Quantsapp. The venue of arbitration will be Mumbai.
Quantsapp Wealth Pvt. Ltd. may amend the terms and conditions, which I acknowledge and agree to follow, as per the Terms and Conditions and our Privacy Policy available on the platform.
I have read and understood the terms and conditions mentioned above and agree to abide by them and any amendments thereto made by Quantsapp Wealth Pvt. Ltd. from time to time.
The Client is aware that mere acceptance of the registration form does not imply in any way that the request has been accepted by Quantsapp Wealth Pvt. Ltd. for providing the mutual fund transaction facilities.
6. UNDERTAKING BY USER
I understand Mutual Fund and market linked investments are subject to market risks, have read all scheme-related documents carefully. Having read and understood the content of the SID / SAI / KIM of the scheme(s) chosen on the platform, I hereby apply for units of the scheme. I have read and understood the terms, conditions, details, rules and regulations governing the scheme hereby declare that the amount invested in the scheme is through legitimate source only and does not involve designed for the purpose of the contravention of any Act, Rules, Regulations, Notifications or Directives of the provisions of the Income Tax Act, Anti Money Laundering Laws, Anti-Corruption Laws or any other applicable laws enacted by the Government of India from time to time. I have not received nor have been induced by any rebate or gifts, directly or indirectly in making this investment. I confirm that the funds invested in the Scheme, legally belongs to me.
I hereby accept that for any transactions that are submitted offline i.e. with wet signatures, the signature available in my KYC records would be used for signature verification. I agree and understand that I shall be solely liable to inform the Distributor/AMC in case of any change in my KYC information including change in signature etc. and in the event of my signature not being updated, available or legible in KYC records, the Distributor/AMC would be within its rights to carry out further checks to validate the authenticity of the request or reject any such offline request based on existing KYC information.
I shall execute and deliver to Quantsapp Wealth Pvt. Ltd. from time to time such other documents as may be required for updation of records if any. I further agree that any false/misleading information given by me or suppression of any material fact will render my account liable for termination.
7. ACKNOWLEDGEMENT
I acknowledge that, I have read the Terms and Conditions which are applicable for investment account facility on Quantsapp Wealth Pvt. Ltd. and that I have thoroughly read and understood the said Terms and Conditions and that a copy of the Terms and Conditions is available on web/mobile application. I hereby severally agree and undertake to abide by these Terms and Conditions. I further agree to accept the updated Terms and Conditions as may be updated from time to time on the mobile app/web application of Quantsapp Wealth Pvt. Ltd. before executing the transactions.
I understand and agree that, pursuant to the Terms and Conditions, I hereby authorise Quantsapp Wealth Pvt. Ltd. to execute my instructions for purchase/redemption/switch/ sell or other transaction/activities in respect of online mutual fund transactions on my behalf, as may be instructed by me from time to time on the web/mobile application.
I hereby declare that the details furnished through the process are true and correct to the best of my knowledge and belief, and I undertake to inform you of any changes therein, immediately. In case any of the above information is found to be false or untrue or misleading or misrepresenting, I am aware that I may be held liable for it and my account may become liable for termination.
I declare that I am not politically exposed, neither a relative of politically exposed person. I hereby declare that the information provided is true and correct to the best of my knowledge. In the event of any change in the information provided, I will notify Quantsapp Wealth Pvt Ltd, immediately.
Privacy Policy
Quantsapp Wealth Pvt. Ltd. is committed to protecting your privacy and working towards offering you a safe, online experience through its mobile app or web application.
We acknowledge the significance of safeguarding the personal information gathered from our clients and web/mobile application users. This privacy policy is applicable to all personal information collected and received through the Quantsapp platform, including both web and mobile applications. We are committed to ensuring the privacy and security of this information.
We use the Personal Information collected about you only as permitted in this Privacy Policy, after your consent. The Privacy Policy appearing on the Site is current and valid containing all modifications and updates. The Privacy Policy may be updated time to time on the mobile /web application of Quantsapp Wealth Pvt. Ltd. before executing the transactions.
SMS Reading
To facilitate user in seamless login, OTP reading is provided. Users have both options to allow auto read or type manually. SMS is used for verification codes.
We are not storing any SMS data once user log in the application.
Remote Assist
The app's usage of Remote Assist is only to provide demo / support via. a live representative, and does not collect or send any information.
Personal Information
The personal information/or personal data, which is collected about you may include information that is of a confidential nature (all such information being "Personal Information"). Personal Information refers to any information that pertains to a natural person and has the capability to identify that individual, either directly or indirectly. Such information can be personal and sensitive in nature as per the indicative list given below:
a. Name, gender, residential / correspondence address, telephone number, email address, date of birth, marital status, or other contact information
b. PAN, Aadhaar, KYC Status, Signature and Photograph;
c. Bank Account details change of bank account details or registration of multiple bank accounts etc. through application forms;
d. Generation and storing password in encrypted form for login credentials;
e. Biometric information obtained, if any;
f. Annual Income and savings profile; and
g. Other information as may be considered as sensitive and personal.
The Privacy Policy is governed by the provisions of applicable law in India, including the Information Technology Act 2000, the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 and other regulatory provisions in place.
Collection of Personal Information
We may collect /receive your Personal Information from several sources. You may provide Personal Information as part of the application or enrollment process. (whether in writing or electronically). Also, we obtain Personal Information about you through Internet technology, including our Site. You agree and understand that your Personal Information shall be collected, processed, stored and used by us, and passed to, transmitted to and processed by our affiliates and other data processors, agents or service providers acting under a contract with us for the purposes identified in this Privacy Policy. Your data could be forwarded to other third-party service providers for seamless execution of transactions and enhancing customer experience of the mobile/web application.
Indirect collection of information by use of our services. We collect information about the services that you use and how you use them. This information includes:
Device information: We collect devicespecific information (such as your hardware model, operating system version, unique device identifiers, and mobile network information including phone number). The company may associate your device identifiers or phone number with your sign in information for better verification process
Log information: When you use our services or view content provided by us, we automatically collect and store certain information in server logs. This includes:

3. device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL

How we use this information, identification & Verification
1. The information we collect from all of our services to provide, maintain, protect and to improve your user experience and the overall quality of our services, to develop new models & analytical tools. We also use this information to offer you tailored content viz giving relevant search results in accordance to the forecast provided by the user
2. When you sign in, we keep a record of your communication to help solve any issues you might be facing. We may use your email address & notification handle to inform you about our services, such as daily updates, price alerts, upcoming events, application improvements & knowledge value adds
3. Our automated systems analyze your inputs to provide you personally relevant product features, such as customized alerts, search results, tailored advertising, and auto reporting of errors & malfunctioning of application
4. We may combine personal information from our service with information, including personal information to make it easier to share things with people you know. We will ask for your consent before using information for a purpose other than those that are set out in this Privacy Policy

You may agree and understand the following:

We may use your Personal Information for the purpose of providing you with the services to which you subscribe, enhanced services and analytics and any service-related activities such as processing instructions, responding to service request, resolve any grievance etc. The same may also be used to contact you whenever required and also to seek your feedback in relation to the offered services.
2. Your contact information (e-mail id, postal address, phone number etc.) may be used by us to send periodic information (through e-mails, posts, SMSs, couriers, critical communications, telephone etc.) on the services or upcoming events or announcements
You agree and understand that we may also disclose your Personal Information in order to

Protect or defend Quantsapp Wealth Pvt. Ltd, their directors, officers, employees or affiliates' rights, interest and property.
We will only use your Customer Information as permitted under applicable law or pursuant to contractual obligations. Most commonly, we will use your Customer Information to perform the Services or to comply with a legal/contractual obligation. We use your Customer Information without limitation, for the following purposes:
1. to verify your identity to register you as a Customer, and create and operate your account(s) with us;
2. to provide any services that you may avail from Quantsapp Wealth Pvt. Ltd.;
3. to perform our obligations that arise out of the arrangement we are about to enter or have entered with you;
4. to send notifications to manage our relationship with you including to notify you of changes to our Services, send you information and updates pertaining to the Services you have availed, and to receive occasional company news and updates related to us or the Services;
5. to extend services or administer a contest, promotion, survey or other site or business feature;
6. to allow you to access specific account information;
7. to process transactions, where requested, under User ID and Password;
8. to comply with legal obligations;
9. to administer and protect our business and the Services, including for troubleshooting, data analysis, system testing, and performing internal operations;
10. for risk control, fraud detection, and prevention;
11. to respond to court orders, establish or exercise our legal rights, or defend ourselves against legal claims;
12. to customize your visit to the Website/App by displaying appropriate content and analytics at our judgment and discretion;
13. to improve customer service to effectively respond to your service requests and support needs;
14. to improve the functionality of our Services based on the information and feedback we receive from you;
15. to monitor trends and personalise your experience;
16. to market and advertise the Services to you; By providing your contact information you have consented to be contacted by us on the said contact Information even if the said contact information is registered under the National Do Not Call ("NDNC") Registry, on your own volition and free will.
Sharing of Personal Information with third parties.
To the extent required or permitted under law, we may share your Personal Information for the uses mentioned herein with the following third parties:
a. Registrar and transfer agent/s, Banks, or authorised third parties who are involved in transaction processing dispatches, etc., of investor's investment with us
b. Distributors or Sub-Brokers, IFAs through whom application of investors are received for investment.
c. Any other organisation for verifying the identity of investors for complying with anti-money laundering requirements.
d. Any Government authority including but not limited to Reserve Bank of India (RBI), or the Security and Exchange Board of India (S.E.B.I).
e. We may share certain Personal Information with third parties such as post office, local and international courier and other intermediaries for correspondence with the investor and for making payments to the investor through Electronic Clearing Services (ECS), NEFT etc.
Personal Information shall be communicated to third persons only for reasons consistent with the purposes for which the data are originally collected or other purposes authorised by law.
Retention of personal information
Breach of Internet Security
Despite our best efforts, if unauthorised persons breach our security control measure resulting in the Site being hacked presenting inaccurate information etc., Quantsapp Wealth Pvt. Ltd, Quantsapp Pvt. Ltd., their directors, officers, employees or affiliate's will not be responsible.
No administrator at Quantsapp Wealth Pvt. Ltd. will have any knowledge of your OTP. It's crucial for you to take precautions against unauthorized access to your OTP, contact details, and mobile phone. Make sure to log out from the platform when you're done. Please be aware that we do not accept any responsibility and do not undertake liability for any unauthorized use of your account.
If You suspect any unauthorized use of Your account, you must immediately notify us by sending an email to [email protected]. You shall be liable to indemnify us due to any loss suffered by us due to such unauthorized use of Your account. It's crucial to note that we provide user information access to our employees, agents, and partners exclusively when it is necessary and we rigorously enforce confidentiality standards for our staff. Nevertheless, we cannot guarantee the confidentiality, security, or distribution of your personal information by third parties beyond the agreements we have in place with them.
Policy Updating
We may periodically update and/or modify this policy to incorporate necessary changes in technology, applicable law, or other factors. We reserve the right to change the terms of this policy or the Terms of Use at any time. Any modifications/changes we implement will become active as soon as we publish the updated policy on our Quantsapp Platform. To keep yourself updated regarding any alterations, we suggest regularly checking this policy for the most recent version. The continued access or use of the Sites or Services will be considered acceptance of the changes.
Our commitment
As an investor, client, or prospective investor/client, you may entrust your funds and personal/financial information to our care. We understand that you expect us to act responsibly and in your best interests. We remain committed to that. When we share client or prospective client information, whether personal or otherwise, we do so under the circumstances briefly described in this policy.
Disclosure:
The disclosure is in accordance with SEBI circular no SEBI/IMD/CIR No. 4/ 168230/09.
Following are the details of the commission earned by Quantsapp Wealth Pvt. Ltd. from various fund-houses:
* all equity funds includes flexi cap funds, Aggressive Hybrid, large, mid & small cap funds, international funds etc
** all debt funds includes Gilt, Income, short term & corporate bond funds, floating rate funds etc
For investors in Mutual Funds from B 30 locations, an additional commission of 0%-2% will be paid from AMC's
Additional B30 1st year Trail Commission: As per SEBI circular SEBI/HO/IMD/DF2/CIR/P/2019/42 dated March 25, 2019, additional B30 1st year trail commission shall be payable only on inflows from retail investors from B30 cities. The term 'retail investor' has been defined by SEBI. Accordingly, It has been decided that inflows of amount upto Rs. 2,00,000/- per transaction, by individual investors shall be considered as inflows from Retail Investors (applicable WEF 15th April 2019).
Quantsapp Wealth Pvt. Ltd. offers only Regular Plans in Mutual Funds. Details of Scheme level commission on Mutual funds are available with the Relationship Managers and would be produced on demand.
Quantsapp Wealth Pvt. Ltd. acts a distributor of mutual funds wherein it distributes products of various mutual funds.
Investment Risks:
Investing in mutual funds carries inherent market risks, and there is no guarantee that the schemes' objectives will be met. There is no assurance of returns on investments made in mutual fund schemes. Past performance of mutual fund schemes does not predict future performance and may not serve as a reliable basis for comparing them to other investment options.
Transactions carried out within the different schemes offered by Mutual Funds are subject to provisions and by the terms and conditions outlined in the relevant scheme-related documents, which include, but are not limited to, the Scheme Information Document, the Statement of Additional Information, or any supplementary documents associated with them.
As with any investment in securities, the price or the NAV of units issued under the schemes can go up or down depending on the factors and forces affecting capital markets.
